hello all, i am from madrid and i need someone explain me this because the forums in spanish are only people shouting
there is new decree, 813/2026, published in the boe the 10 of october. from the 28 the casino must check that the card belongs to the same person of the account before they let you deposit or take out
ok fine. but for the accounts that exist already they give six months to do this check, and in this six months you can deposit and you can play but you cannot take out the winnings until they verify you
i have 340 euro in one account. so from next week i can put more in but i cannot take out. is this correct or am i reading it wrong

Hey guys, you're reading it right, and I've been through the decree this morning so let me lay out what it actually says rather than what the headlines say.

- Royal Decree 813/2026, published in the BOE on 10 October, in force 28 October.
- Article 21 is the payments one. The operator has to confirm the holder of the payment method is the person registered to the account, and it applies before deposits *and* before withdrawals.
- They have to keep records of the ownership check on a customer's initial transactions.
- Operators get six months to adapt their payment verification, customer identification and account management systems.
- Existing customers during that window: deposits and play continue, withdrawals are held. The transitional provision is explicit that affected customers "may not withdraw the winnings they have obtained."
- At the end of the window, any account still without verified payment ownership has to be terminated. Balances including the withheld winnings get returned, subject to AML and counter-terrorist-financing rules.
- Operators report activations and closures to the DGOJ.
- Remote identity checks have to meet Sepblac's minimum standards. DNI counts in physical and digital form.
- Separately, the electronic identification and data retention obligations kick in 18 months after publication, so not now.

The intent is third-party payments. Somebody depositing with a card that isn't theirs is the laundering route they're closing. Whether that's what it does to you in practice is a different question.

thank you, this is more clear than anything i read in spanish part of terminate the account after six months nobody is saying. so if the casino is slow with the verification it is me who loses the account

I've been saying a version of this on here for two years and getting told I'm paranoid, so forgive me for the tone.

Every time someone posts about a KYC-free casino, I say the same thing: they don't ask at signup, they ask when you try to take money out. I have never once met a casino that paid a jackpot without identity proof. Spain hasn't invented anything here. It has written down what was already happening and put a deadline on it.

@v1t@l practical advice, and do this before the 28th rather than after. Get the verification done now, while nothing is blocked and nobody is in a queue. Card in your own name, name matching the account exactly, and if you've got an e-wallet in the middle be ready to prove the bank account behind it too. The people who get stuck are the ones who start the process after they've already got winnings sitting there.

Also from Spain and I did mine in August when the draft was going around. Took four days and two uploads becuase the first photo wasn't good enough. Do it now. In November every support queue in the country is going to be the same queue.

oh yeah so they can hold your winnings for six months and still take deposits the whole time. unbeleivable. i have money stuck in two places already waiting on verifcation and now this is the law

@pokerslave55 this one's Spain only, it doesn't touch your two. But if you've got withdrawals pending in two places at once and you're still depositing into them, that's worth a pause on its own, separate from any of this. Get the verification finished on both before you put anything else in.

yeah sure or use a wallet where nobody asks whose name is on anything. just saying

I'm the crypto degen on this forum and even I'm not going to pretend that's the answer here. Crypto gets you past the deposit side, yes. It does not get you past the withdrawal side on any licensed site, and on an unlicensed one you've swapped a six month verification queue for a counterparty who can close the tab whenever they want. I've wagered a fair bit on Bitstarz over the years and they still asked me for documents when it mattered.

@v1t@l if you're in a regulated Spanish market with a licensed operator, so boring answer is the right one. Verify now, keep the receipts.

What's interesting to me is the direction of travel because the us has been doing the same thing from a totally different angle
Credit card deposits are basically gone here now. Draftkings pulled them nationwide late summer last year, Fanduel followed, BetMGM went in a march, bet365 and Caesars digital both ended it in an april. hard rock finished their rollout end of july. Fanatics never took them at all
and i cant give you clean dates for half of those which annoys me. nobody wrote them down properly at the time, its all "followed later" and "last march" with no year attached

The credit card question has a cleaner answer than the gambling arguments around it usually allow, and it isn't really about gambling at all.

A gambling deposit on a credit card is normally processed as a cash advance. That means no interest-free period, interest from the day of the transaction, and a cash advance fee on top. You are borrowing at the worst rate that product offers in order to fund something with a negative expected value. There is no bankroll strategy in which that is the correct instrument.

Warren's letters in February made the fee argument specifically - her line was that gamblers "should not have to deal with undisclosed credit card fees that rig the odds against them." You can think she's wrong about plenty and still find that one hard to argue with.
