Different companies, same product category. Kalshi is the exchange that's been fighting the states in court. DraftKings has its own version called Predictions. Robinhood and Crypto.com run them too. The court rulings about Kalshi set the rules everyone else has to live under, which is why a case about one company matters to all of them.
 
funniest part is kalshi caught it themselves, froze his account and reported him to the CFTC. which is genuinely the exchange doing surveillance properly, and it lands in the same week a court says they're not really an exchange at all
 
that's the bit that gets me actually. he got caught because the surveillance works. and how many of those are running that nobody catches because the person isn't standing next to the president??
 
A fair question, though I would point out the same is true of every market that has ever existed. Insider trading prosecutions are rare relative to insider trading. It is not an argument against exchanges. It is an argument for supervision, which is precisely what both sides of this case claim to be offering.

does it bother you that the only reason you can bet at all is a court case that might go the other way in a year? im really curious not diggin' or smth

It bothers me a great deal. It's also better than the thing it replaced, which was nothing.

You're in Nevada. Your position is that a company should be licensed by the state before it takes your money, and you're right, and I'd want that too. But Texas has had thirty years to give me a regulated option and hasn't, and the people arguing hardest that Predictions is illegal here aren't offering me a legal alternative. They're offering me a driving licence and a map to Louisiana.

So yes. It's a window. I'd rather have a door. Until somebody builds one I'm going through the window.
 
sure they're in it. tribal gaming authorities have filed alongside states on this and its a bigger deal than the state cases in some ways because exclusivity compacts are the whole basis of tribal gaming revenue and a federally regulated exchange routes straight round them
im not going to pretend i understand the compact law well enough to say how that lands

well that's an advertising standards question not a gaming one and nobody's brought it yet as far as i know
the nevada board went at it from the other end. dreitzer said the contracts are indistinguishable from sports bets and doing it unlicensed in nevada is illegal. that's a much bigger stick than a misleading ad complaint
 
honestly that's the thing from outside. betfair's done this since 2000 and nobody needed a circuit split to work out what it was
the difference is it got licensed as gambling from the start instead of arguing it was a commodity
 
im still not opening anything new till the en banc decision.i've been burned by a platform disappearing before and honestly i don't care how good the pricing is if the money's in a queue
